Французский писатель XIX века, Виктор Гюго, сказал: «Право – это всё то, то истинно и справедливо», в своих произведениях он всегда был на стороне обездоленных и оскорбленных, выступал за защиту их прав.

В настоящее время международное сообщество исследуют права человека и их защиту как базовый идеал, основу поступательного развития и процветания, критерий устойчивости и стабильности. Весь мир движется в этом направлении.

День прав человека отмечается 10 декабря — именно в этот день в 1948 году Генеральная Ассамблея Организации Объединенных Наций приняла Всеобщую декларацию прав человека — эпохальный документ, в котором были провозглашены неотъемлемые права, присущие каждому человеку вне зависимости от его расы, цвета кожи, пола, языка, религии, политических или иных убеждений, национального или социального происхождения, имущественного, сословного или иного положения. Декларацию переводят чаще, чем любой другой документ в мире: ее текст существует более чем на 500 языках.

Хотя Декларация не является обязательным к соблюдению документом, она способствовала введению более 60 инструментов в области прав человека, сформировавших единый международный стандарт в данной сфере.

16 декабря 1966 года Генеральной Ассамблеей ООН были приняты Международный пакт об экономических, социальных и культурных правах и Международный пакт о гражданских и политических правах, вступившие в силу в 1976 году. Заключенные под эгидой ООН четыре международных документа (Всеобщая декларация прав человека; Международный пакт об экономических, социальных и культурных правах; Международный пакт о гражданских и политических правах; Факультативные протоколы к Международному пакту о гражданских и политических правах) составляют Международный билль о правах человека (International bill of human rights).

На основе этих международных документов Совет безопасности ООН может применять принудительные санкции против режимов, допускающих явные нарушения прав человека.

Ведущей структурой ООН в области прав человека является Управление Верховного комиссара ООН по правам человека (Управление ООН по правам человека).

Верховный комиссар и Управление наделены мандатом с целью раскрытия случаев нарушения прав человека по всему миру, помощи в разработке стандартов для оценки прогресса в области прав человека во всем мире, проведении мероприятий исследовательского, просветительского и информационного характера для повышения осведомленности и участия международного сообщества и общественности в правозащитной деятельности. Путем присутствия на местах Управление помогает предотвращать нарушения, разрешать ситуации, которые могут привести к конфликту, осуществляет мониторинг и анализ для принятия решений и планов развития, обеспечивает юридическое консультирование тысячам людей.

Совет по правам человека ООН – межправительственный орган системы ООН. Был создан в марте 2006 года на основании резолюции Генеральной Ассамблеи ООН.

В него входят 47 стран, ответственных за поощрение и защиту всех прав человека по всему миру. В компетенцию Совета входит обсуждение всех тематических вопросов и ситуаций в области прав человека, которые требуют его внимания в течение всего года.

Всеобщий уровень сотрудничества государств в области прав человека дополняется региональным, что позволяет учитывать политические, исторические, культурные, экономические особенности региона и отражать это в принимаемых документах. К ним, в частности, относятся Европейская конвенция о защите прав человека и основных свобод (1950), Европейская социальная хартия (1961), Американская конвенция о правах человека (1969), Африканская хартия прав человека и народов (1981) Арабская хартия о правах человека (1994).

Права человека в области образования, культуры, науки предусмотрены в конвенциях, принятых в рамках ЮНЕСКО. В частности, 14 декабря 1960 года была принята Конвенция о борьбе с дискриминацией в области образования. Такой дискриминацией является всякое различие, исключение, ограничение или предпочтение, цель или следствие которого состоят в уничтожении или нарушении равенства отношений в области образования, проводимых по признаку расы, цвета кожи, пола, языка, религии, политических или иных убеждений, национального или социального происхождения, экономического положения или рождения.

Развитие концепции прав человека привело к тому, что права ребенка были выделены в особую категорию. В 1959 году ООН приняла Декларацию прав ребенка, в которой были провозглашены социальные и правовые принципы, касающиеся защиты и благополучия детей. 20 ноября 1989 года Генеральная Ассамблея ООН приняла Конвенцию о правах ребенка. Конвенция содержит 54 статьи, учитывающие практически все, что касается жизни и положения ребенка в обществе. Документ, в частности, включает требования, обеспечивающие выживание детей, их развитие, защиту, доступ к медицинской помощи, образованию, обеспечению участия в жизни социума.

История создания Декларации, как и праздника, посвященного защите прав человека, тесно связана с мировой историей – со Второй мировой войной. Ужасающие последствия войны заставили задуматься о том, как сделать так, чтобы подобное больше никогда не повторилось, чтобы не возникало сомнений, что люди равны между собой.

Равенство и правозащитный подход к развитию – это лучший способ сократить неравенство и продолжить двигаться к осуществлению Повестки дня до 2030 года.

Для защиты прав человека сейчас существуют международные сообщества, которые созданы в целях регуляции поведения не только отдельных личностей, но и целых государств.

Основанная на правах человека экономика может прервать циклы нищеты. Крайняя бедность, распространённое неравенство и структурная дискриминация являются нарушениями прав человека и одними из самых больших трудностей нашего времени. Их эффективное решение требует мер, основанных на правах человека, новой политической приверженности и участии каждого и в особенности наиболее пострадавших.

Права человека, включая экономические, социальные и культурные права, а также право на здоровье и право на безопасную, чистую, здоровую и устойчивую окружающую среду занимают центральное место в создании новой, основанной на правах человека экономики, которая поддерживает более гармоничное, справедливое и устойчивое общество для нынешних и будущих поколений. Экономика на основе уважения прав человека должна стать базой нового общественного договора.

Ухудшение состояния окружающей среды, включая изменение климата, загрязнение и истощение природных ресурсов, оказывает несоразмерное воздействие на отдельных людей, группы и народы, находящиеся в уязвимом положении. Это воздействие усугубляет уже существующее неравенство и негативно сказывается на правах человека нынешних и будущих поколений. Теперь, когда Совет ООН по правам человека признал право человека на чистую, безопасную и устойчивую окружающую среду, необходимо принять срочные меры для соблюдения, защиты и осуществления этого права.

Предупреждение конфликта и наращивание устойчивости за счет равенства, инклюзии и прав человека

Права человека помогают бороться с истинными причинами конфликта и кризиса, обеспечивая рассмотрение жалоб, искореняя неравенство и изоляцию и позволяя людям принимать участие в процессе принятия решений, которые затрагивают их жизнь. Общество, которое защищает и поощряет права человека каждого, является более устойчивым и лучше подготовлено за счет прав человека к внезапным кризисам, таким как пандемии и последствия климатического кризиса.

Сейчас мы живем в демократическом государстве, обладаем многими личными и политическими, правами, правами в экономической жизни, правами социальными, правами в культурной области и экологическими правами.
